KAMUZORA, J 5 May & 21 July 2026 thst The appellant instituted proceedings against the respondent in the Primary Court of Babati (hereinafter referred to as "the trial court"), seeking a refund of TZS 1,800,000/=, being the purchase price allegedly paid to the respondent for a refrigerator which was subsequently found to be defective, together with compensation for the loss allegedly suffered as a result of being unable to use the refrigerator for its intended business purpose.
