LUVANDA, J The Appellant and Respondent above named, purchased their respective piece of land from the same vendor namely Muharami Ally Mbegu (deceased), whereby the Respondent purchased a piece of land measuring 40 by 100 feet on 29/01/2015, as per hati ya mauzo/manunuzi ya shamba exhibit D1; the Appellant purchased a piece of land measuring 60 by 40 feet on 24/02/2015, as per hati ya ununuzi wa kiwanja/shamba exhibit P1.
